FDA Warnings

The FDA recently has been active in sending out warning letters to beauty brands making unapproved drug claims, and in September and October 2012, the FDA issued warning letters to Lancôme, Greek Island Labs, Janson Beckett, Andes Natural Skin Care, Bioque Technologies and Avon Products.

According to David Steinberg in his January 2013 contribution to GCI sister publication Cosmetics & Toiletries, “US and Canada Updates: Canadian Cosmetic Harmonization and the FDA’s Claim Crackdown,” the FDA considers these claims to be drug-related under its definition of “intended to affect the structure or any function of the body of man or other animals.” Steinberg notes that some of those listed above are clearly drug claims but some have been considered “cosmetic” claims.
